1. Service Description

Voxably ("we," "us," or "the Service") is an AI-powered conversational coaching platform. Users make phone calls to AI personas and receive automated coaching reports analyzing their performance. The Service is designed for sales training, communication coaching, and professional development.

2. Acceptance of Terms

By creating an account or using Voxably, you agree to these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

3. Call Recording Consent

All calls made through Voxably are recorded and transcribed. Recording is a core requirement of the Service — it enables coaching analysis, report generation, and performance tracking. By using Voxably, you explicitly consent to the recording and transcription of all calls you make through the platform.

Call recordings and transcripts are stored securely and associated with your account. You may review your recordings and transcripts at any time through the dashboard.

4. AI-Generated Content Disclaimer

Coaching reports, scores, feedback, and recommendations provided by Voxably are generated by artificial intelligence. This content is intended as a training and development tool and should not be treated as professional, legal, medical, or psychological advice. AI-generated scores and assessments may contain inaccuracies. Use your own judgment when interpreting results.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Harass, abuse, threaten, or direct hate speech toward the AI personas
• Attempt to manipulate, exploit, or reverse-engineer the AI systems
• Share account credentials or allow unauthorized access
• Use the Service to generate content that is harmful, misleading, or fraudulent
• Interfere with or disrupt the Service or its infrastructure
• Resell or redistribute access to the Service without written permission

6. Accounts & Access

You are responsible for maintaining the security of your account and password. Voxably cannot and will not be liable for any loss or damage from your failure to maintain account security. You must provide accurate, current information when creating your account.

7. Subscription & Billing

Voxably offers subscription plans billed on a recurring basis through Stripe. By subscribing, you authorize us to charge your payment method on each billing cycle.

• Free trial: New accounts may include a free trial period. You will be charged at the end of the trial unless you cancel before it expires.
• Auto-renewal: Subscriptions automatically renew at the end of each billing period. You may cancel at any time from your account settings.
• Cancellation: When you cancel, your access continues until the end of the current billing period. No partial refunds are provided for unused time.
• Price changes: We may change pricing with at least 30 days notice. Continued use after a price change constitutes acceptance.

8. Data Ownership

You retain ownership of your data, including call recordings, transcripts, and coaching reports. We do not sell your data. You grant us a limited license to process your data solely for the purpose of providing and improving the Service.

9. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or use the Service in a manner that threatens the integrity or availability of the platform. We will make reasonable efforts to notify you before termination, except in cases of severe violations.

10. Limitation of Liability

To the maximum extent permitted by law, Voxably and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

12. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
